Sunderland Council cancels another 33 of Herron's parking tickets

Sunderland City Council lost their case against Herron in Frederick Street ... but ignored the NPAS Adjudicator's decision and kept issuing.
They lost the case against Mark xxxxxx and requested a review. It was rejected by NPAS but they kept issuing.

Parking Attendants were told by NCP and the Council to 'keep issuing.'

NCP claimed that the reason they were not issuing was because the machine was broken, however a source within NCP confirmed that the machine had simply been turned off.

Finally it appears that the Council are admitting that they do not have a valid Traffic Order for the location.

They have cancelled the Herron tickets ... but have you had one here?

If so then you are entitled to your money back. Sunderland City Council had no legal authority to levy fines or charge for pay and display tickets ... the TRO was wrongly drafted.

If you have paid for a pay and display ticket at this location then you are entitled to ask for your money back.
If Sunderland City Council refuse then you need to make a formal complaint and then complain to the Local Government Ombudsman.

If you believe that the ticket was issued by the Council knowing that there was no valid TRO in place then a complaint needs to be made to the Police.

Errr, but according to NPAS, there was nothing wrong with any of Sunderland's TROs!!!

...and a little birdie tells me that the machine in St. Thomas Street isn't working and that NCP has a letter sitting on the manager's desk telling them not to issue in either Frederick Street or St. Thomas Street.

Is it not the case that one who makes gain for himself or another by exposing another to a risk of loss by using false representation is guilty of fraud.

Is it not also the case that one who dishonestly abuses a position to make gain for himself or another by exposing another to a risk or cause of loss, is also guilty of fraud?


The fraud act 2006 which was granted Royal Assent November 2006 is quite clear.

If so, no I don’t have a life.

Bugger now I'm being hit with inheritance tax, life (and death) is so unfair,

Perhaps the answer is just to retire, it there any retirement vacancies available in Sunderland City Council at the moment?

inheritance tax bollocks my grandad died aged 93 he left me £400,000 in a will after paying tax all his damn life he was again taxed in his death, now i have some money am comfortable but still work and still pay tax however when i die and leave my kids money they will be taxed on the money i was taxed on the money my grandad was taxed on. WELL DONE BLAIR

But you must feel happy knowing that Tony, the MP’s and all council workers can retire at 55 (even though most people think you retire the day you start working for the council) and YOU have made it all possible.

I wake up every day and thank God for the amount of tax I pay, and how the current government are spending it on making things better for themselves (sorry I meant us)

Information now passed on that the pay and display machine in St. Thomas Street is now working.
The instruction given to PAs with regard to Frederick Street is that the machine in Frederick Street is 'broken' and that is why PCNs are not being issued there.
Motorists are therefore being misled ... as they are going into St. Thomas Street to buy tickets.

As a ex PA with NCP Sunderland i had a conversation with a PA who is still working in Sunderland this week. I asked about Fredrick street and the PA said that they had been told that there is a fault with the machine not that the traffic orders are wrong. How can NCP as a company lie / keep the on street PA's in the dark when their on company motto is TICK Team work, Integrity, Customer focus, and Knowledge. NCP managment are just as much to blame as the council. A lot of the behaviour and conduct in the NCP office that was reveled on the BBC back in October was never stopped or questioned until October how can you know that it is not acceptable when you are on your break and not in full uniform if no one has ever told you in my eyes NCP only care about how much money they make for themselves and the council are no better. The same PA's are still going to be walking the streets in council uniforms and the lines, signs, and traffic orders will still be wrong

Don't believe everything the PA's say they are now made to lie for fear of jobs being lost. Some (especially PA 261) could lie for a living! This sort of attempted cover up is common practice in NCP and the council, in fact it was going on regularly and the PA's never got to know about it.

Frederick St machine will be in full working order, they will have turned it off to save face. As for the public paying in St Thomas street instead I am sure a precedent for that was set in West Sunniside just before the Sunniside redevelopment took place, so surely more refunds from the incompetent council.

well am sure the last anon would know all about the lies an bullying that goes on inside ncp as he was last SPA, am sure there is more to come from the council and mr heron. being an ex employee myself it wont surprise me

by remaining anonymous just shows 'the cut of your jib' and proves that you are indeed a dickhead. Why don't you return to under the rock you crawled out and go play with your colouring book.

To Neil, please keep up the good work and your uphill struggle to expose the cash cows and corrupt council. You have my support and thousands from Sunderland. Well done.
