York Drivers Happy With Parking Fines (from York Press)

I wonder how transparent the Council is with regard to informing motorists of their right to appeal to the adjudicator, or could it be that most parking tickets are handed out to tourists unfamiliar with the area and its parking regime and who simply pay up as the perceived hassle of appealing is simply not worth it.

I have yet to meet a motorist who is 'happy' to receive a parking fine.

Just received a York Penalty Charge Notice, stating "CODE 15 Parked in a residents' parking space without clearly displaying a valid residents' parking permit". However, like most spaces in York, the space allows a few minutes' parking to non-permit holders. Does this mean the PCN is invalid?

It seems to me it doesn't meet the requirements of the Road Traffic Offenders Act 1991 66(3), which says a PCN "must state the grounds on which the attendant believes that a penalty charge is payable with respect to the vehicle". The attendant's belief, presumably, was that I had overrun the non-permit holders' limit, not the sentence quoted above.

So, presumably, the notice is invalid, and like thousands of other drivers, I have no obligation to pay?
